That would mean every single software that can run on the emulator is illegal, either because it will run an illegal copy of a licensed game or because it will run an unlicensed game. If unlicensed games are illegal then homebrews are too. I ask because since even homebrews do run on the NES, they also would qualify as unlicensed. If I managed to run an unlicensed game I made on my Xbox One without breaking it's DRM, could MS sue me? What was and is the legality of that? Could Nintendo back in the day sue a company that made unlicensed games? Can it now? What about the licensing requirement to make software that runs on the NES?
